Selection: On or before July 18, 2021, Global Listening Centre intends to select the top 25 Outstanding Women Listeners in the world for 2021. Global Listening Centre reserves the right to modify, suspend, or terminate the Event in its sole discretion. Global Listening Centre also reserves the right to change these rules, in whole or in part, in its sole discretion.

Selection Process: The top 25 Outstanding Women Listeners will be selected by Global Listening Centre in its sole discretion.

Disclaimer: Global Listening Centre does not claim that the top 25 Outstanding Women Listeners are only the best listeners in the world. To the contrary, the top 25 Outstanding Women Listeners are persons deemed by Global Listening Centre, in its sole discretion, to be established and exceptional listeners. The purposes of this Event are to inform members of the international community about the importance of listening and to promote listening awareness internationally.

No Purchase or Payment: No purchase or payment of any kind is required to be selected by Global Listening Centre in connection with this Event. Employees, members, chairs, and board members of Global Listening Centre are not eligible to be selected to the list of the top 25 Outstanding Women Listeners for 2021. This Event is void where prohibited. Participation in this Event constitutes full and unconditional acceptance of these rules, disclaimer(s), releases, and the decisions of Global Listening Centre, which are final and binding in all matters related to this Event.

Participation and Release of Liability and Damages: By participation in this Event, participants expressly agree to release and hold harmless Global Listening Centre, its divisions, affiliates, advertisers, promoters and each of their respective officers, directors, chairs, employees, agents, and representatives from and against all claims, causes of action, and damages, including, but not limited to, personal injury, death, and damage to or loss of property (including, without limitation, loss of wages, earnings, benefits, employee compensation, bonuses, profits, and dividends), arising out of, related to, and/or in connection with this Event.

Promotion, Privacy, Waiver, and Consent: Except where prohibited, all participants in the Event agree and consent to the use, without payment, compensation, and/or consideration whatsoever, of their name, likeness, photograph, voice, opinions, statements, and/or hometown, state, and/or country for promotional or other lawful purposes, including, without limitation, social or other types of media worldwide.

Dispute Resolution Mechanism: All disputes, claims, and causes of action arising out of, related to, and/or in connection with this Event shall be resolved individually without resort to any form of class action and exclusively by arbitration without resort to any legal action whatsoever. The seat of all such arbitrations shall be Kolkata, West Bengal, India. The law of India shall be the applicable law for all such arbitrations. All such arbitrations may be conducted online or in person by a single arbitrator. The decision of such arbitrator shall be final and binding on the parties. The expense for all such arbitrations, including, without limitation, the arbitrator, and any arbitral institution, shall be borne equally by the parties to such arbitration, except each party to all such arbitrations shall bear their own attorney’s fees and expert witness’ fees. Participants in the Event shall be limited to out-of-pocket expenses, not to exceed One Thousand Rupees only, for all claims, causes of action, and damages of every kind whatsoever, including, without limitation, special, general, compensatory, treble, penalties, and punitive damages, arising out of, related to, and/or in connection with the Event.

Governing Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these rules, disclaimer(s), releases, and all other issues related to Global Listening Centre and/or the Event shall be governed by, construed in accordance with, and enforced under the laws of India, without giving effect to any choice of law or conflict of law rules. All challenges to the arbitrator, the arbitration, and/or the arbitration award shall be decided by The Calcutta High Court, Kolkata, West Bengal, India, which shall have exclusive jurisdiction to hear and decide such matters. All such decisions of the Calcutta High Court, Kolkata, West Bengal, India, shall be binding and final.
